Contractual Terms and Conditions

Below are some important clauses from our Wedding Photography Contract - although they are important, they are not set in stone and are negotiable - we are open to discuss with you any of these clauses and may alter some of them to suit you.

PARTIES CO-OPERATION: The parties agree to a cheerful co-operation and communication for the best possible result within the definition of this assignment. The Photographer recommends that the Client designate an "event guide" to point out important individuals for informal or candid photographs to the photographer during the event. The Photographer is not responsible if the key individuals fail to appear or to cooperate during photography sessions.

COPYRIGHT AND OWNERSHIP: All of the photographs produced by the Photographer throughout the event are protected by the British and International Copyright Laws and remain the intellectual property of the Photographer unless the payment for the services rendered was made in full by the Client prior to the production of the photographs, in which case the copyright ownership of the resulting images is automatically transferred to the Client.

SECURITY DEPOSIT, PAYMENT SCHEDULE AND REFUNDS: On signing of this agreement by both parties hereto, the Client shall pay the Photographer a deposit of 30 (Thirty) per cent of the agreed total fee by cheque thus securing the agreed date and time to be reserved. Once such payment is received, the Photographer shall reserve the time agreed upon and will not make another reservation for the specific time frame. If the event is cancelled for any reason later than seven days before the agreed date, this deposit shall not be refunded. If the Photographer cancels this Agreement, the reservation deposit shall be returned to the Client immediately in full. The remaining balance (70 per cent of the agreed total fee) must be received by the Photographer no later than 10 working days before the event date (if paid by cheque) or on the day of the wedding prior to any shooting (if paid in cash). No photography will take place and no rights shall be granted until the payment is made in full.

LIMITATIONS OF LIABILITY: The Photographer agrees that every effort shall be made to provide high quality photographic services. In the unlikely event that a catastrophic mechanical failure should occur to the Photographer's equipment or transport or the Photographer is unable to provide the Client with the agreed upon photography services in whole or in part, due to (including, but not limited to) a fire or other casualty, acts of God or nature or terror, a burglary or other causes beyond the control of the parties, the Photographer agrees to reimburse the Client for all amounts paid to date but shall have no further liability with respect to this agreement.
